సామాన్యుడి ప్రాథమిక ప్రజాస్వామ్య హక్కు అయిన ఓటు హక్కు “తీవ్ర ప్రమాదంలో” ఉంది -సుప్రీంకోర్టు మాజీ న్యాయమూర్తి రోహింటన్ ఫాలి నారిమన్

భారత ఎన్నికల సంఘం (ఈసీఐ) పనితీరు, నియామకాల ప్రక్రియపై సుప్రీంకోర్టు మాజీ న్యాయమూర్తి రోహింటన్ ఫాలి నారిమన్ రాజ్యాంగపరమైన ఆందోళన వ్యక్తం చేశారు. సామాన్యుడి ప్రాథమిక ప్రజాస్వామ్య హక్కు అయిన ఓటు హక్కు “తీవ్ర ప్రమాదంలో” ఉందని ఆయన హెచ్చరించారు.
అక్టోబర్ 4న రాజ్కోట్లోని రాజ్కుమార్ కళాశాలలో “రాజ్యాంగం-సామాన్యుడు” అనే అంశంపై మాట్లాడుతూ, జస్టిస్ నారిమన్ ఎన్నికల సంఘం స్వాతంత్ర్యాన్ని ప్రశ్నించారు. ప్రధాన ఎన్నికల కమిషనర్ , ఇతర ఎన్నికల కమిషనర్ల చట్టం, 2023 చెల్లుబాటుపై వీలైనంత త్వరగా సుప్రీంకోర్టు నిర్ణయం తీసుకోవాలని ఆయన కోరారు.
“కాబట్టి ఈ రోజు నేను లేవనెత్తాలనుకుంటున్న మొదటి విషయం ఏమిటంటే, మన రాజ్యాంగం ప్రకారం, మన రాజ్యాంగానికి, మన ప్రజాస్వామ్యానికి గుండెకాయ వంటి సామాన్యుడి ఓటు హక్కు నేడు తీవ్ర ప్రమాదంలో ఉంది,” అని ఆయన అన్నారు.
పశ్చిమ బెంగాల్లో ఓటర్ల జాబితాల ప్రత్యేక విస్తృత సవరణ (SIR) సందర్భంగా పెద్ద ఎత్తున ఓటర్ల పేర్లను తొలగించినట్లు వచ్చిన నివేదికల నేపథ్యంలో ఆయన ఈ వ్యాఖ్యలు చేశారు. ఇతర ఇద్దరు ఎన్నికల కమిషనర్ల అభ్యంతరాలను సైతం లెక్కచేయకుండా, ప్రధాన ఎన్నికల కమిషనర్ (సీఈసీ) అనేక కీలక నిర్ణయాలు తీసుకున్నారన్న నివేదికలను కూడా ఆయన ప్రస్తావించారు.
“పశ్చిమ బెంగాల్ ఎన్నికలలో 90 లక్షల మంది ఓటర్లు తమ ఓటు హక్కును కోల్పోవడం మీరందరూ చూశారు, ఇది ఒక ఆశ్చర్యకరమైన సంఖ్య,” అని ఆయన అన్నారు. ఈ ప్రక్రియను నిలిపివేయడానికి సుప్రీంకోర్టు ఎందుకు జోక్యం చేసుకోలేదని ఆయన ప్రశ్నించారు.
ఓటు హక్కు కోల్పోయిన ఓటర్లలో, సుమారు 22 లక్షల మంది అప్పీళ్లు దాఖలు చేయగా, కేవలం లక్ష అప్పీళ్లపై మాత్రమే తీర్పు వెలువడిందని, అందులో 93% తీర్పులు ఓటర్లకు అనుకూలంగానే వచ్చాయని ఆయన అన్నారు.
“అయితే మీరు ఊహించగలరా? ఒక ప్రభుత్వం తనకు కావలసింది సాధించుకోవడం కోసం, భారత పౌరుడైన సామాన్యుడిని ఇది పూర్తిగా చట్టవిరుద్ధంగా అణచివేయడమే,” అని ఆయన అన్నారు.
Former Supreme Court Judge Rohinton Fali Nariman has expressed constitutional concerns regarding the functioning and appointment process of the Election Commission of India (ECI). He warned that the right to vote—a fundamental democratic right of the common man—is in “grave danger.”

Speaking on the topic “The Constitution and the Common Man” at Rajkumar College in Rajkot on October 4, Justice Nariman questioned the independence of the Election Commission. He urged the Supreme Court to deliver a verdict as soon as possible on the validity of the Chief Election Commissioner and Other Election Commissioners Act, 2023.
“So, the first point I wish to raise today is that, under our Constitution, the common man’s right to vote—which is the heart of our Constitution and our democracy—is in grave danger today,” he said.
He made these remarks against the backdrop of reports regarding the large-scale deletion of voters’ names during the Special Intensive Revision (SIR) of electoral rolls in West Bengal. He also referred to reports indicating that the Chief Election Commissioner (CEC) had taken several key decisions while disregarding the objections raised by the other two Election Commissioners. “You all witnessed 90 lakh voters losing their right to vote in the West Bengal elections; this is a staggering figure,” he said. He questioned why the Supreme Court did not intervene to halt this process.
He noted that among the voters who lost their voting rights, approximately 22 lakh filed appeals, yet verdicts were delivered on only one lakh of them—with 93% of those rulings favoring the voters.
“But can you imagine? This is a case of a government completely unlawfully suppressing the common Indian citizen just to achieve its own ends,” he said.
